Consider taking a laptop or memory stick to the mediation with a draft settlement agreement (obviously with blanks in the critical parts). Many people shy away from doing this on the basis that it "tempts Providence".On the contrary, I believe it has real merit in that it focuses your team on the ‘Holy Grail’ of a legally binding settlement agreement entered into voluntarily and it ensures by careful prior consideration that all matters relevant to settlement are considered in advance (not just at the point of settlement when exhaustion may affect judgement). Finally, of course, it may serve to save much time at the point when people with far to travel are anxious to leave.
